1.ALL PROGRAMS INCLUDE:
1.1 ALL rooms in hotels Listed on each schedule, by its name or by its category or another alike, have private bathroom. Guests, who want to Lodge in single rooms, will have to pay extra charge for this service.
1.2 Usually, the check out time in the hotel is 14:00, but it may happen that even if the customer arrives before that hour, no room can be provided at the moment. On the other hand guests will have to Leave their room the check out day before 12h00, or will have to pay extra fee for using the room out of time limit, if hotel demands so.
1.3 ALL programs include only continental breakfast, excepting when any other meal is established on schedule.
1.4 Meals included shown Like that in itinerary, have been hired with hotels or restaurants in group mode and with fixed menu, therefore they should be done according to schedules and menus selected on each case.
1.5 In and out transfers on each city, whenever it is specifically indicated, will be done in private buses. ALL transfers are based on a minimum of 2 persons arriving or Leaving together in the same airport, port, station or any other place where this service is provided. If this minimum is not reached and there is just one person, no transfer will be provided unless requested by the guest and extra fee for each case will be paid.For providing these services will be necessary to have information on definitive flights within 5 working days before the beginning of services.
If a passengers do not reach our transfer, they should call immediately to the 24 hours phone assistance service, so the proper transfer service can be provided.
1.6 Visits and tours shown on each schedule, with Local or, eventually, multilingual, guides on requested language.
1.7 Air, terrestrial, autocar, or microbus transportation with reclinabLe seats and conditioned air when established so, depending on the number of persons on each departure date.
1.8 Assistance of a specialized tour guide will be included on circuits regularly programmed but only if there is a minimum of 4 persons in the tour. If the minimum required is not reached, a guide-driver service will be provided. These services will start with autobus services in the city where the tour/program begins, but there may be no guide assistance during the stay in the first and Last city of your tour.
1.9 Handling of one medium size bag for each person in airports, train stations, ports, terminals and hotels. Extra Luggage will have to be paid directly by each customer to our guide or local office, according to the rates existing on each place where this service is required. Eventually and for technical reasons, this service is not included, so it is useful to check if this service is available in hotels chosen by passenger.
1.10 Tourist class air tickets, in programs where it is included and in the specified routes for each case. If it is not mentioned, they are excluded.
1.11 ALL ship cruises in Galapagos Islands do not include: tips, alcoholic beverages fee to the Galapagos National Park, tickets to and from the continent and in some cases sodas and juices. ( Only the cruise aboard the Galapagos Explorer II includes the fee of US$ 100 to the Galapagos National Park)
1.12 No itinerary includes entries for museums, National parks or monuments.
2. RATES DO NOT INCLUDE:
2.1 Visas, airport fees, and/or entry or leaving fees, vaccination certificates, "extras charges" such as coffee, wine, liquor, water, special meals, laundry, optional hotel services
and, in general, any other service not included in the previous paragraph or not specifically detailed in the program/offer, in the contract or in the documents given to the customer when
it is signed, not even in middle continental plan or in full continental plan, except if other thing is accorded in the contract.
2.2 Optional visits, which are not part of the contract, if they are not originally accorded. Its inclusion on this booklet is only for information purposes.
2.3 Whenever guests require supplements, such as single rooms, etc. if by any circumstance the service can not be provided, the only responsibility on the organizing part is to reimburse the proportional paid amount for such service, with out right to any other claiming on the guest's part. Such rule will be applied as well if, by any cause, any hotel would not provide private bathroom or shower.
2.4 In general, any other item not clearly specified in the previous paragraph number l.
3. SPECIAL RATES FOR CHILDREN
3.1 No charge will be done for children under 2 years old traveling with two adults (one child with two adults maximum) only if they do not use one seat in autocar and if they staying
in the same room with adults. Adults traveling with them will pay extra charges caused by children in hotels, restaurants, etc.
In the cruises to the Galapagos Islands the children under 15 years old aboard the Galapagos Explorer II will pay 50% of the fare if they are accompanied by an adult in the same cabin.
Children under 7 years old are not aloud in the cruise. In the cruises Legend, Grand Coral, Coral I and Coral II children under 12 years old pay 50% of the fee when they are accompanied by
two adults in the same cabin. In the combine programs to Galapagos Islands there are not discounts for children.
3.2 Special 10 % discount on price the will be applied only for children who are within two years and eleven years old, traveling with two adults and sharing the same room. Regarding to air, train or ship tickets, etc. existing rules will be applied on each case according to each company.
3.3 A Request, for granting these special conditions, should be done 15 days before the beginning of the tour. This should include the child's information regarding his/her age, which should be justified at the beginning of the services. If children's information, regarding their age, does not match with information included on request, adults traveling with them will pay the difference at the beginning of services.
3.4 In any case, the number of children traveling in the tour/program will be Limited; therefore their confirmation will depend on existing reservations at the moment of request.
4. MODIFICATIONS
4.1 Operators reserve for themselves the right to change, by major reason and without previous notice, any service or sequence on the itinerary, with no responsibility on this. If a trip is cancelled totally or partially. Operators shall only reimburse the paid amount.

5. LUGAGGE OR PERSONNAL OBJECTS.
5.1 In autocar trips, one medium piece of Luggage will be transported for free, with a maximum weight for person of 30 k.
Luggage and other personal belongings are not part of travel contract, it is understood for all purposes that the tourist will carry his belongings with him all the time, regardless the place in car or the hotel where they are placed. It is understood also that they are carried by the tourist on his own risk, therefore the operator will not be urged to respond if lost or damage is caused.
It is advisable for passengers to be present when luggage is handled and claim immediately to the transport company or the hotel if any damage, deficiency is seen.
6 VIGENCY
6.1 This booklet is valid during the period of time included from the beginning of the first published departure up to the last one. In other cases, its legality, and therefore, application of conditions, is included between the dates of beginning of the first and the end of the last service.
6.2 All the prices of programs included on this booklet are based on rates and currency existing on January 2002, therefore, they are ruled by changes that may happen in rates and changes for currency after dates published and without previous notice.
7. NOTES
7.1 Passenger shall leave his country with his passport and visas in order. The operator is not responsible, in any case, on damage or harm that may be caused by deficiencies on this subject. The operator will apply on each case the proper conditions to cancel and resign voluntarily the services.
7.2 If any departure included on this booklet would not reach the minimum of passengers required, or by any other justified cause. Operators would be forced to cancel this departure; the registered passengers will be reimbursed only the amount paid up to the moment, resigning to any other claiming.
7.3 The operator is entitled, according his criteria, to request any passenger, who is not behaving properly, to Leave the tour. Whenever it happens the only obligation of the operator is to reimburse completely the services that have not been used by the passenger, once extra charges that might be caused, are deducted.
8.CANCELLATIONS
8.1 ALL cancellations received at least 15 days before the beginning of services will not have any charge, excepting reservation expenses, which will be billed by 50 US dollars
(fifty US dollars) by each request cancelled plus any additional charge that may happen.
8.2 Cancellations received after that date besides administrative charges and others mentioned on 8.1, will have a charge according to the following scale:
8.2.1 Between 14 and 10 days, 10% of the total of paid services.
8.2.2 Between 9 and 6 days, 20% of the total value of paid services.
8.2.3 Between 5 and 3 days, 30% of the total value of paid services.
8.2.4 Two days before, 40% of the total value of paid services.
8.2.5 No show or cancellation one day before of departure, will mean 100% of cancellation expenses. Also any other charge or expense that may be produced, will be billed.
8.2.6. If tour includes ship cruises, train tickets, or any other services, which have different General Conditions than the ones established previously, these ones will not be applied but the ones regarding to each case. The operator will bill expenses that, because of cancellation or modification, may receive on the part of the operators, hotels or service providers.
8.3 ALL services not taken or cancelled by passengers, during
their trip, will not be reimbursed.
9. PAYMENT
9.1. ALL requested services should be paid totally, at Least 10 days before their beginning. Payment up to the arrival of passengers may, however, be accepted, previous request as Last deadline. If this requirement is not accomplished, the operator is entitled to not accepting the passenger at the beginning of the tour, or to accept him during a determined period of time.
9.2. All payments shall be done in US dollars, throughout bank transfers or bank checks, excepting previous authorization on the Operator's part, or if these are services hired between both parts via Internet, credit cards or any other kind of negotiation that might be settled on contract.
10. CLAIMS
10.1. To acknowledge all claims that may be presented by any cause, the passenger as well as the operator will be submitted to the Equatorian court judgment, resigning previously to any other that might correspond.
10.2. Claims will be attended only if they are made by written, enclosing all the coupons/vouchers not used or the necessary certifications of service providers.
10.3. Claims received 10 days after finishing the hired services, will not be admitted because of delay.
11. RESPONSABILITIES
11.1. As tour operators and representing our partners, we declare that we act as intermediaries between customers, on one part and persons or entities called to provide services on different schedules, such as hotels, transport companies, airlines, train companies, cruise Lines, other operators, etc. On the other hand we are responsible for the accomplishment of services offered in programs, but we do not accept responsibility by: delays, strikes, earthquakes, quarantines, or any other major cause reason, as well as by any Lost, damage, accident that may occur to passengers and their belongings, whenever these are caused by third ones, and therefore, not able to be controlled by the operator and/or their associated agents. Likely, we are excluded of any prejudice by modification or delay on the air routes included in programs.
11.2.When making a reservation in any of our programs or the acceptance in the itineraries or touristic services, is stablish that the traveler ar any other intermediary company, accept all and each of the conditios of this general terms.
11.3. If by lodging difficulties or any other justified cause, passengers cannot be lodged in hotels included on this booklet or in any other itinerary where these General Terms are applied, they will be Lodged in same or superior category hotels nearby, without claim on the part of passengers.
11.4. Selling these programs by any of our agents does not mean they are responsible on causes imputable to the operator, only if they have not hidden the operator's name.
11.5 The Equatorian Tourism Law will govern subjects not included on these terms, but laws published in the country where the operator is addressed may have prior application.
